1. Acceptance of Terms

By accessing or using My Streaky ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. My Streaky is operated by its founder ("we", "us", or "our").

2. Description of Service

My Streaky is a language learning habit tracker that allows users to log study sessions, manage flashcard decks, track CEFR-level progress, plan study calendars, and interact with a community of language learners. The Service is provided "as is" and may be updated or modified at any time without prior notice.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. You must be at least 13 years of age to use the Service.

4. User Content

You retain ownership of any flashcard decks, study data, or other content you create on the Service ("User Content"). By making content public, you grant My Streaky a non-exclusive, royalty-free license to display and distribute that content to other users of the Service. You are solely responsible for your User Content and represent that it does not violate any third-party rights or applicable laws.

5. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Upload content that is offensive, defamatory, or infringes intellectual property rights.
• Attempt to gain unauthorized access to our systems or another user's account.
• Use automated scripts to scrape, crawl, or extract data from the Service.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

6. Intellectual Property

All materials provided on My Streaky - including but not limited to the design, logo, code, text, and graphics - are the property of My Streaky or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written consent.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy or completeness of any content on the Service.

8. Limitation of Liability

To the fullest extent permitted by applicable law, My Streaky shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid to us, if any, in the twelve (12) months prior to the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may also delete your account at any time from your account settings.

10. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator resides, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
